AI-generated or AI-assisted content is provided for general informational, promotional, visual, or illustrative purposes and may contain errors, omissions, approximations, or variations.

AI-generated or AI-assisted images may not depict the exact appearance, color, size, texture, consistency, ingredients, packaging, serving suggestion, presentation, or other characteristics of the product you receive. Such content must not be understood as altering any product-specific written disclosure, ingredient statement, allergen declaration, net quantity, price, or other material term presented at the time of purchase.

Before purchasing or consuming a product, you should review the product-specific written information displayed on the applicable product page and the information printed on the product packaging. If an AI-generated or illustrative image conflicts with a product-specific written disclosure, the product-specific written disclosure controls, subject always to applicable law. Please contact SOMSAUCE before purchasing if any material product information is unclear.

Nothing in these Terms authorizes or excuses a false, misleading, or unsubstantiated product claim. SOMSAUCE does not intend to use AI-generated or AI-assisted content to conceal or materially misstate a product's identity, quantity, ingredients, allergens, price, origin, or other characteristics that would be important to a reasonable consumer's purchasing decision.

ALLERGEN NOTICE. SOMSAUCE products contain fish, specifically anchovy, a major food allergen. Do not purchase or consume a SOMSAUCE product if you are allergic or sensitive to fish. Ingredients, suppliers, and manufacturing practices may change, so review the complete ingredient statement and allergen declaration on the applicable product page and on the product packaging each time you purchase. Website disclosures supplement and do not replace any labeling required by applicable law. If you have an allergy, dietary restriction, or medical concern and are uncertain whether a product is appropriate for you, contact SOMSAUCE before purchasing and consult a qualified healthcare professional as appropriate.

All product descriptions and availability are subject to change, but no change will limit any right or remedy that cannot lawfully be limited. When you place an order, you are making an offer to purchase. SOMSAUCE reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until SOMSAUCE confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as SOMSAUCE may be unable to accommodate cancellation requests after an order is accepted. SECTION 4 - PRICES AND BILLING

Advertised or displayed prices will include all mandatory fees or charges imposed by SOMSAUCE, except for government-imposed taxes or fees and reasonable shipping costs, as permitted by applicable law. This provision does not limit any right you may have under applicable law if an order is not delivered, arrives damaged, is materially nonconforming, or cannot be fulfilled within a legally required period.

Title and risk of loss pass only at the time and in the manner permitted by applicable law. Nothing in these Terms transfers to you the risk of loss caused by SOMSAUCE's breach, improper packaging, shipment of the wrong product, or other act or omission for which responsibility cannot lawfully be disclaimed.

If a material error affects an order after it has been submitted, SOMSAUCE may contact you for instructions, offer a lawful substitute only with any consent required by law, or cancel and refund the affected portion of the order. Nothing in this section permits SOMSAUCE to retain payment for a product it does not provide as agreed or limits any non-waivable consumer right or remedy.

General informational, promotional, illustrative, AI-generated, or AI-assisted content made available through the Services may contain errors or limitations and should not be treated as professional medical, nutritional, legal, or other professional advice.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WARRANTY PROVIDED BY SOMSAUCE, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." SOMSAUCE DISCLAIMS WARRANTIES REGARDING THE OPERATION OF THE WEBSITE OR OTHER SERVICES ONLY TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. HOWEVER, NOTHING IN THESE TERMS DISCLAIMS OR LIMITS ANY IMPLIED WARRANTY, STATUTORY GUARANTEE, PRODUCT-SAFETY OBLIGATION, OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL INJURY, GROSS NEGLIGENCE WHERE IT CANNOT LAWFULLY BE LIMITED, VIOLATION OF LAW, DEATH OR PERSONAL INJURY CAUSED BY ACTIONS FOR WHICH LIABILITY CANNOT BE DISCLAIMED, OR ANY OTHER LIABILITY OR REMEDY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent.

SOMSAUCE may assign or transfer these Terms without restriction.

SECTION 23 - GOVERNING LAW

These Terms and any separate agreement under which SOMSAUCE provides the Services are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent the law of your place of residence provides mandatory consumer protections that cannot lawfully be waived.

Subject to any non-waivable right to bring a claim in another forum, you and SOMSAUCE consent to jurisdiction and venue in the state and federal courts located in San Diego County, California. Nothing in this section waives any right, remedy, forum, or procedure that cannot lawfully be waived.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 25 - CHANGES TO TERMS OF SERVICE

We may update these Terms by posting a revised version on the website and changing the "Last updated" date. When required by applicable law, we will provide additional notice or obtain consent before a material change becomes effective.

Changes apply prospectively from their stated effective date and will not retroactively reduce rights or materially expand obligations relating to a completed transaction unless the change is permitted by law and any required notice or consent has been provided.
